President Trump declared victory on social media following a Supreme Court ruling that restricted federal judges’ ability to block his birthright citizenship order through nationwide injunctions. The 6-3 decision, authored by conservative Justice Amy Coney Barrett, represents a significant shift in how courts can respond to executive actions.
The ruling emerged from legal challenges to Trump’s first-day executive order that would deny citizenship to children born in the United States unless at least one parent is a U.S. citizen or permanent resident. According to plaintiffs, this directive would affect more than 150,000 newborns annually, fundamentally altering America’s approach to birthright citizenship.
Three federal judges in different states had issued comprehensive injunctions stopping the policy’s implementation while legal challenges proceeded. The Supreme Court’s conservative majority determined these broad orders exceeded appropriate judicial authority, though they maintained a 30-day delay before any policy changes could take effect.
Justice Sotomayor’s dissent sharply criticized the majority’s approach, arguing they deliberately avoided addressing the executive order’s constitutionality. She characterized the administration’s legal strategy as “gamesmanship” and accused the court majority of enabling potentially illegal government actions by restricting judicial oversight mechanisms.
